      On this page you will find our Terms of Conditions, which are our legal and administrative policies regarding privacy, response time and customer support, copyright, purchases, refunds, our media policies, and other policies which we utilize in the course of our business. By accessing this site and/or purchasing our programs/services you are agreeing to abide by our Terms and Conditions.SIGRID VAN HEERWAARDEN and DW GROUP both honor the same T&C and Privacy Policy available on www.join-gifted.comWe state ‘SIGRID VAN HEERWAARDEN’ to also refer to the DW GROUP.For clients convenience the Terms and Conditions are also available in the Divine Wealth App to revisit after purchase.
    2. Service Level Agreement, Customer Support and Terms of Response

      Our standard response time for emails is within 24 to 48 hours or 1 to 2 business days, with exceptions for holidays and weekends.We do not offer 24×7 customer support and cannot guarantee a reply if requests are not sent to our support mailbox, which is team@sigridvanheerwaarden.com.While we do our best to resolve issues, those situations that are caused through your actions, such as removal or unsubscribing from a list, not reading instructions, not downloading our app, not adding our email address to your mailbox as instructed so emails are not received or end up in your spam folder, or incomplete purchases, can sometimes not be resolved to your satisfaction.These will be addressed on a case by case basis and we do not take responsibility for issues caused by your actions that are beyond our control. We will make every attempt to ensure that you receive your purchase but cannot and will not assume responsibility for situations resulting from your actions that directly interfere with how a purchase is completed or directly subvert the purchase process.
    3. Digital File, Terms of Use & Copyright Notice

      All programs/services purchased or otherwise accessed on any website managed by Sigrid van Heerwaarden are copyrighted material, and are protected by Dutch and international copyright law. When you purchase any of these products you are agreeing to abide by the terms of our File Sharing, Posting, Download, Divine Wealth App Use, Copyright & Terms Of Use Notice, as described in the next section.
    4. File Sharing, Posting, Download, Divine Wealth App Use, Recording Access, Terms of Use & Copyright Notice

      All material on any of the websites owned and maintained by Sigrid van Heerwaarden and the DW Group is copyrighted and protected under Dutch and international copyright law.It is illegal and a violation of Dutch and international copyright laws to share any type of print or digital media files with others, use them outside of the limits of the stated policies, and post them on shared or accessible sites, especially when such activities are expressly and specifically forbidden by the copyright holder.You are expressly and specifically prohibited from sharing any print or digital media files with anyone, for any reason, posting them on any on-line site, including blogs or cloud-based environments, or otherwise distributing, sharing, or using them in any form whatsoever.The copy you purchase or have access to as part of a program/service is for your personal use only and may not be shared or posted, as noted above, or used as part of a class, seminar, in any program, or with your clients.All file downloads are audited and monitored. If you choose to disregard our download sharing policy and share these files you will be charged the full price of the program and/or download, or not less than 100 euro, for every illegal file posting, share, or download, plus attorney fees and applicable Court Costs. We reserve the right to charge penalties based on the statutory limits as set by the Dutch Copyright Act. We prosecute everyone who violates these policies to the fullest extent of the law. In case of unforeseen events, and not receiving the welcome email send the request to team@sigridvanheerwaarden.com to receive the steps to download the Divine Wealth App.We state ‘Divine Wealth App’ which access the recordings to also refer to Zoom and/or Facebook and/or Instagram to access LIVE classes.The access period is stated prior to the purchase in the sales + welcome email and/or the sales page/ and/or payment link.

      To get access to the recordings of the purchased programs it is the purchaser’s responsibility to download the Divine Wealth App or use the app weblink to access the recordings. In no case it is the responsibility of SIGRID VAN HEERWAARDEN when the purchaser does not have access to devices to access or does not choose to download/ sign in for the Divine WealthApp, Zoom or Facebook.

      In case you do not remember your password or the specific email account you made the purchase with, send an email to team@sigridvanheerwaarden.com. When purchasing different programs under different email addresses, note that program access to the recordings can only be accessed under the email address of purchase. In case of purchasing with different email addresses the purchaser can access the recordings with the email address of purchase. Each email address of purchase has a separate login and password. In no exception can this be changed.

      In case of 1:1 mentoring it is the responsibility of the purchaser to record 1:1 sessions. These are not hosted in the Divine Wealth App.

      Access to the content in the Divine Wealth App will be removed when payment plans are not fulfilled/ charge backs are done or after the duration of access has expired.

      You are expressly and specifically prohibited from sharing any print or digital media files with anyone, for any reason, posting them on any on-line site, including blogs or cloud-based environments, or otherwise distributing, sharing, or using them in any form whatsoever.

      The copy you purchase or have access to as part of a program/service is for your personal use only and may not be shared or posted, as noted above, or used as part of a class, seminar, in any program, or with your clients.

      All file downloads are audited and monitored. If you choose to disregard our download sharing policy and share these files you will be charged the full price of the program and/or download, or not less than 100 euro, for every illegal file posting, share, or download, plus attorney fees and applicable Court Costs.     5. Programs/Services/ Last Minute Cancelation

      Programs may include audio, video and pdf files, as well as individual and group online and in-person mentoring/ retreat options. Once a program/service has been accessed through payment you are considered as having participated in the program/service. The start date being the date which is clearly communicated in the welcome email, when paid for the program/service.1:1 Mentoring sessions are scheduled by the purchaser with a scheduling link. Sessions can be canceled and rescheduled until 48 hours in advance. Send an email to team@sigridvanheerwaarden.com to cancel. The purchaser reschedules their session with the provided link.VIP Days, in-person retreats and programs can not be canceled.
    6. Payment of the Programs/Services

      The Terms & Conditions are binding for the duration of the program/service. After registration for any program/service/retreat/event you shall be subject to payment of the total amount irrespective of the payment arrangements agreed.All programs/services purchased are 100% non-refundable. In the absence of timely payment, SIGRID VAN HEERWAARDEN is entitled to claim the full outstanding amount without any reminders and/or notice.SIGRID VAN HEERWAARDEN is entitled to refuse participation in the program/service, without prejudice to the obligation of the participant to pay the amount owed to SIGRID VAN HEERWAARDEN.If a participant prematurely terminates a program/service, no partial refunds shall take place.If applicable, payment in installments for the relevant program/service must be paid in full.Only in case of serious illness which makes it impossible for the participant to continue the program/service (in the future) can a written partial refund be requested for the remaining part of the program.

      The judgment of SIGRID VAN HEERWAARDEN is decisive in this.

      If necessary, certificates from a GP or medical specialist should be given.

    7. Cancellation of the program

      In case of cancellation of the program by SIGRID VAN HEERWAARDEN a refund will take place for the part of the program in which you have not received the service, access to the program, or event.
    8. Liability

      SIGRID VAN HEERWAARDEN accepts no liability if it appears that you are acting irresponsible, or have concealed or withheld any medical or other important information for the program/service. You remain responsible at all times for what is happening in and with you and the decisions and actions taken in response to the scholar during the participation in the program/service. Because you are responsible for your own actions, SIGRID VAN HEERWAARDEN can never be held liable for your welfare.
    9. Privacy

      During the execution of the program/service, the protection of the personal data of the participants by SIGRID VAN HEERWAARDEN is of the greatest importance. Your personal data will therefore be treated with the greatest care.SIGRID VAN HEERWAARDEN processes your data in accordance with the Personal Data Protection Act.All team members working for SIGRID VAN HEERWAARDEN are obliged to respect the confidentiality of the data at all times.SIGRID VAN HEERWAARDEN uses information from participants exclusively for relationship management and operations, including enrolling participants, to send you relevant information for activities and meetings, and to send you information about the products and related information.If you do not wish to receive any more information, please unsubscribe using the unsubscribe link at any of the received emails.Please read the full privacy policy under PRIVACY POLICY AND COOKIE AND DATA STORAGE POLICY at the bottom of this document.
    10. Property

      You shall not be entitled to make copies of the material made available and/or to make the material available to third parties. The attributable copyright and/or ownership of the material remain with SIGRID VAN HEERWAARDEN.Without the explicit and prior written authorisation of SIGRID VAN HEERWAARDEN, reproduction and/or distribution of the materials made available makes the participant liable for damages.SIGRID VAN HEERWAARDEN is the only one entitled to make sound and/or image recordings during the experiences to ensure quality.
    11. Use of Likeness

      You agree and accept that SIGRID VAN HEERWAARDEN is authorized to record or otherwise capture your likeness, voice, images, and statements made in connection with your participation in the program (except for private 1:1 sessions) for SIGRID VAN HEERWAARDEN’s own use.You hereby assign to SIGRID VAN HEERWAARDEN all rights, title, and interest to have and to use, royalty free, any such likeness or portion of your participation in the program for documentary and training, or any other lawful purpose.
    12. LIVE Retreats

      When it comes to COVID-19, Sigrid van Heerwaarden follows all local mandates, regulations, and recommendations for group interactions.This may impact in-person retreats/ in-person events and they may therefore be canceled. You will be notified about any cancellation well in advance.
    13. Complaints Procedure

      If you have complaints with regard to a program/service, you must make it known in writing to SIGIRD VAN HEERWAARDEN (team@sigridvanheerwaarden.com) within 14 days after the occurrence of the complaint.After examining and discussing the complaint with the participant, SIGRID VAN HEERWAARDEN will give the best possible execution to the chosen solution direction.
    14. Governing Law

      These Terms and Conditions shall be governed and construed in accordance with laws of the Netherlands and the Emirates.
    15. Change of Conditions

      You can review the current version of our Terms & Conditions on our website via www.join-gifted.com New terms and modifications to the existing conditions will be made known via our website. It is your responsibility to check our website periodically for any changes.
    16. Derogation from the Conditions

      Deviation from these Terms and Conditions are only valid if this has been agreed in writing with SIGRID VAN HEERWAARDEN.

DISCLAIMER

None of our programs/services is accompanied by any guarantee of results. We cannot guarantee results for you because that is entirely dependent on your level of commitment and desire for change.

Any stated or posted testimonials for results have come from customers, students, and clients who have completed sessions, work, or programs with Sigrid van Heerwaarden and reported their unique, individual results.

Under no circumstances do we guarantee or state that these results can be replicated by others. Transformation, success, and life changes require a high level of commitment, discipline, and desire and those are up to the individual to implement in their lives.
